Terms and Conditions
1 Use of website
1.1 By viewing the UCAS Media website the user (“you”) is deemed
to consent to all terms and conditions set out below. If you have any questions
regarding the terms and conditions, you should contact the Company Secretary at
UCAS Media Limited.
1.2 UCAS Media Limited reserves the right at all times to vary,
change, alter, amend, add to or remove any of these terms and conditions. By browsing
the Website you accept that you are bound by the current terms and conditions and
notices. Please ensure that you review these terms and conditions each time you
revisit the site as you will be deemed to have accepted a variation if you continue
to use the Website after the variation has been posted.
1.3 The current draft of these terms and conditions was adopted
and published on 5 December 2006.
2 Copyright
2.1 All copyright and other intellectual property rights in any
material contained on the Website are either owned by UCAS Media Limited or have
been licensed to UCAS Media Limited by the rights’ owners. The Website contains
trademarks which belong to UCAS Media Limited or which have been licensed to UCAS
Media Limited by the trademark owners, for use on the Website. Your use of these
trademarks is forbidden unless prior written permission has been obtained from the
trademark owner.
2.2 You may access any part of the Website and download or copy
material (by printing off individual pages onto paper) or download material on to
disk (but not on to any server or other device connected to a network unless expressly
permitted by UCAS Media Limited) for personal non-commercial use only. The intellectual
property rights in such material shall be retained by UCAS Media Limited or, where
the material has been licensed to UCAS Media Limited, by the owners of the rights
in the material.
2.3 Links to the UCAS Media website are not permitted other than
to the Home Page for personal use except with prior written permission. Links to
the UCAS Media website from within a frameset definition are not permitted except
with prior written permission.
2.4 You may not remove any copyright, trademark or intellectual
property notices contained in the original material from any material downloaded
or copied from the Website.
2.5 Copying, distributing or any use of the material contained
on the Website for any commercial purpose is prohibited.
2.6 You may not create a database by systematiy downloading substantial
parts of the Website.
3 Disclaimer
3.1 The content of the Website is for general information only
and does not constitute any form of advice or recommendation upon which a specific
decision should be made. UCAS Media Limited has done its best to ensure the accuracy
and currency of the materials contained on its Website but to the fullest extent
permitted by law excludes any warranty, whether express or implied, by statute at
common law or otherwise, relating to the Website and the material contained on the
Website, in particular (but without limitation of the above), UCAS Media Limited
gives no warranties as to quality, accuracy, timeliness, completeness or fitness
for a particular purpose of the Website or of the material contained in it.
3.2 To the fullest extent permitted by law UCAS Media Limited will
not be liable for any claims, costs, penalties, loss (whether direct, indirect or
consequential and whether economic or special loss), damages or expenses arising
from the use or from the inability to use the Website or from reliance on information
or on advice contained on the Website or from any unauthorised access or alteration
to the Website by a third party.
3.3 Nothing in these terms and conditions shall exclude liability
for death or personal injury directly caused by the negligence of UCAS Media Limited
nor any other liability which cannot be excluded or limited under applicable law.
3.4 UCAS Media Limited will try to make the Website available but
cannot guarantee that the Website will operate continuously or without interruptions
or be error free and can accept no liability for its unavailability. You must not
attempt to interfere with the proper working of the Website and in particular you
must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt
any computer system, server, website, router or any other internet connected device.
You are also advised to use the appropriate antivirus software before and during
access to the Website.
3.5 Whilst the Website may from time to time contain advertising
material, UCAS Media Limited and its Parent Company do not endorse or accept any
liability for any of the products or services so advertised, or for any error or
inaccuracy in the advertisements. Advertisers and sponsors are responsible for ensuring
that material submitted for inclusion on the Website complies with all relevant
laws.
3.6 The Website includes links to external websites. These links
are provided to help you find additional information quickly and easily. UCAS Media
Limited accepts no responsibility for the content of these websites and specifiy
excludes (to the fullest extent permitted by law) all liability that may arise with
respect to or as a result of such material causing damage, costs, injury or financial
loss of any kind.
4 Personal Information
4.1 “Personal Information” where provided is information about
you, which you provide to UCAS Media Limited from the input areas within the Website.
For individuals a privacy policy is as set out below. The information we collect
from time-to-time may include: name; postal and email address; and telephone number.
5 Privacy Policy
5.1 At UCAS Media Limited we have adopted the following privacy
policy as part of our commitment to protect your Personal Information where this
is provided.
5.2 We will not sell, trade or rent your Personal Information to
others. When you engage in certain activities on the Website, such as registering
for an event, subscribing to a newsletter, or downloading information, we will ask
you to provide certain information about yourself by filling in an online form.
The information you provide will be kept confidential and will be used to support
your relationship with UCAS Media Limited. From time to time we may use this information
to provide you with relevant information from UCAS Media Limited we think would
be of particular interest. We will always give you the opportunity to opt out of
receiving such direct marketing. We will follow the appropriate legal requirements
to ensure that no third parties see your Personal Information save as set out in
these terms and conditions.
5.3 If you do not wish your Personal Information to be used for
UCAS Media Limited marketing purposes by post you must ensure that you tick the
box on the relevant page.
5.4 You will need to tick the appropriate boxes if you wish to
receive such information by electronic means.
5.5 The Website may contain links that make it easy for you to
visit other websites. UCAS Media Limited does not have any control over these websites.
Therefore, if you use these links to leave UCAS Media Limited and visit websites
operated by third parties, UCAS Media Limited cannot be responsible for the protection
and privacy of any information that you provide whilst visiting these websites.
5.6 UCAS Media Limited may use cookies. A cookie is a small amount
of data which is stored on your computer and which is revealed to UCAS Media Limited
when you use this Website. UCAS Media Limited uses cookies only to make it easier
to identify you when using the Website. UCAS Media Limited does not use cookies
to collect additional information about you. You can configure your web browser
not to accept cookies, although this may hinder the functionality of the Website
for you.
5.7 You may, at any time, withdraw your permission for UCAS Media
Limited to use your Personal Information for the purposes of sending you information
about UCAS Media’s products or services. If you would prefer not to receive marketing
information, our e-bulletin, invitations to seminars, updates on developments and
such like, then email us at ucasmedia@ucas.ac.uk
or write to the Data Protection Officer, UCAS Media, Rosehill, New Barn Lane, Cheltenham,
GL52 3LZ. You may also write to our Data Protection Officer if you have any questions,
or wish to have any of your Personal Information edited or deleted.
5.8 Under the Data Protection Act 1998 you may request UCAS Media
Limited to provide you with details of Personal Information that UCAS Media Limited
holds about you. If you want to make a request for this information you should write
to our Data Protection Officer at the above address. There will be a fee of £10
payable. A cheque for this amount should be sent to UCAS Media Limited with your
request for information.
6 General
6.1 These terms are not intended to confer any benefit on a third
party under the provision of the Contracts (Rights of Third Parties) Act 1999.
6.2 Any rights not expressly granted herein are reserved to UCAS
Media Limited.
6.3 UCAS Media Limited reserves the right, at any time, to suspend
or terminate your access to, or use of, the Website.
6.4 UCAS and UCAS Media Limited will always seek criminal prosecution
of any individual who or organisation which seeks to use UCAS’ or UCAS Media’s name/s,
material, logos or trademarks for unlawful purposes and, where appropriate, will
take action within the civil courts of any applicable jurisdiction against any individual
or organisation discovered to be using UCAS' and/ or UCAS Media’s name/s, logos,
trademarks or the Website for unauthorised or unlawful purposes.
6.5 These terms & conditions of use shall be construed and
interpreted in accordance with English law. The courts of England shall subject
as set out in clause 6.6 have exclusive jurisdiction in relation to any claim, dispute
or other matters arising therefrom.
6.6 For the exclusive benefit of UCAS Media Limited, UCAS Media
Limited shall retain the right to bring proceedings in the Courts of the country
of residence of any user of the Website.
6.7 If any provision of these terms and conditions is found to
be invalid by any Court having competent jurisdiction, the invalidity of that provision
will not affect the validity of the remaining provisions of these terms and conditions
which shall continue to have full force and effect.
6.8 The failure by UCAS Media Limited to exercise any right or
remedy under these terms and conditions shall not constitute a waiver of that right
or remedy.
6.9 The services and the Website of UCAS Media Limited are provided
to support the work of the Universities and Colleges Admissions Service (UCAS).
UCAS, a company limited by guarantee registered in England and a registered charity
is the ultimate parent company of UCAS Media Limited (registered in England). UCAS
also owns and manages the websites http://www.ucas.ac.uk/, http://www.ucas.co.uk/
and http://www.ucas.com/.
